Fold down rear seat - passenger side doesn't latch?

Hello,

I have an E46 BMW M3 - in good shape - bought with 63K miles, had 2 of the big 3 done etc.

Recently, folded down the rear seats to transport a bike. When I go to flip the passenger side rear seat, it doesn't latch. Any ideas as to what I might try? Cable to the handle works, and latch appears to be in idnetical position to the drivers side one, however, the seat does not quite latch and instead reaches the point where it should and hits the latch point as if the latch is locked out.

One of the three images below shows the rear seat in a not quite latched position.

Any ideas? Assuming this might be a common E46 problem but haven't found it immediately on a google search...
